Welcome to Culina Home. These Terms of Service govern your use of our website and the purchase of products from our online store.
Culina Home is an online retailer specializing in kitchen accessories, home essentials, and household products. Our store is powered by Shopify.
Please read these Terms carefully before placing an order. Nothing in these Terms limits or excludes any mandatory consumer rights available under applicable law.
1. Seller Information
The online store Culina Home is operated by:
Legal business name: Adam Haburaj
Trading name: Culina Home
Business registration number (IČO): 57931445

The seller is established in the Slovak Republic and operates as a sole trader registered under Slovak law.
Culina Home is the seller responsible for customer orders, contractual obligations, delivery, returns, and statutory consumer rights, even where fulfillment or shipping is carried out by third-party suppliers.
2. Scope of These Terms
These Terms apply to purchases made through the Culina Home online store.
Our products are primarily intended for consumers purchasing goods for personal or household use.
A consumer is a natural person acting for purposes outside their trade, business, or profession.
Certain mandatory consumer protection rules may not apply to purchases made for business purposes.
These Terms should be read together with our Privacy Policy, Shipping Policy, and Return & Refund Policy.
In the event of a conflict between these Terms and mandatory consumer protection legislation, the applicable mandatory legislation shall prevail.
3. Products and Product Information
We aim to provide accurate descriptions, photographs, prices, and relevant information about the products offered on our website.
Product appearance, including colors, may vary slightly depending on screen settings and lighting.
Before placing an order, customers should review the product description, dimensions, materials, intended use, and any safety information provided.
We reserve the right to update product descriptions and discontinue products. Such changes do not affect orders already accepted, except where permitted by applicable law.
All products offered for sale must comply with applicable product safety and consumer protection requirements in the markets where they are sold.
4. Customer Accounts
Customers may be able to place orders as guests or through customer accounts, depending on the features available on our website.
You agree to provide accurate and complete information when creating an account or placing an order.
You are responsible for keeping your account login details secure.
Please contact us if you suspect unauthorized access to your account.
We may restrict account access where reasonably necessary to prevent fraud, misuse, or unlawful activity, without affecting your statutory rights or existing contractual claims.
5. Ordering and Contract Formation
To place an order, customers select products, add them to the shopping cart, enter the required delivery and payment details, review the order, and submit it through checkout.
Before submitting an order, customers will have the opportunity to review the products, quantities, prices, shipping charges, and total amount payable.
Submitting an order constitutes an offer to purchase the selected products.
A purchase contract is formed when Culina Home accepts the order and communicates that acceptance to the customer through an order confirmation or another clear confirmation of acceptance.
We may decline an order before acceptance for legitimate reasons, including product unavailability, suspected fraud, or an obvious pricing error, subject to applicable law.
If payment has already been collected for an order that is not accepted, the payment will be refunded without undue delay.
Once a purchase contract has been formed, neither party may cancel it except as permitted by these Terms, the agreed cancellation arrangements, or applicable law.
Customers will receive the required contractual information and confirmation on a durable medium, such as email, in accordance with applicable law.
6. Prices, Taxes and Payments
Product prices are displayed in the currency selected or shown on our website.
The applicable product price and any shipping charges will be disclosed before the customer submits an order.
The checkout will display the total amount payable to Culina Home, including applicable taxes and charges collected by us.
We accept the payment methods displayed at checkout.
Payments are processed by authorized third-party payment service providers. We do not intentionally store complete payment card details on our own systems.
Prices may be changed for future orders without notice. Price changes will not affect purchase contracts already concluded.
Any additional charges that customers are required to pay must be disclosed in accordance with applicable law before the purchase.
7. International Orders, Customs and Import Charges
Customs Duties and Import Taxes: Customers are responsible for paying any applicable customs duties, import taxes, and customs clearance fees imposed by the destination country that are not collected at checkout. These charges are not included in the product price or shipping fee unless explicitly stated otherwise. The amount of these charges may vary depending on the destination country and local customs regulations.
Culina Home may accept orders from customers in different countries, subject to available shipping destinations and applicable legal restrictions.
Some products may be shipped internationally, including directly from fulfillment partners located in China.
International shipments may be subject to customs clearance, import duties, import VAT, handling fees, or other charges imposed by the destination country.
Before an order is placed, we will provide the information required by applicable law about any additional delivery, customs, or import costs that the customer may be required to pay.
Customers should not be charged undisclosed mandatory fees contrary to applicable consumer protection rules.
Nothing in this section removes any statutory responsibility of Culina Home as the seller.
8. Shipping and Delivery
We deliver to the countries and regions available at checkout.
Estimated Delivery Time: Orders are typically delivered within 10 calendar days from the date of order confirmation. Delivery times are estimates and may vary depending on the destination, customs processing, and circumstances beyond our control. Customers will be informed of any significant delivery delays. Your statutory delivery rights remain unaffected.
Delivery options, shipping charges, and expected delivery periods are provided in our Shipping Policy and, where applicable, during checkout.
Some products may be dispatched directly by third-party fulfillment partners outside the European Union.
We will take reasonable steps to fulfill orders within the agreed delivery period.
For consumer sales governed by Slovak law, goods must generally be delivered without undue delay and no later than 30 days after conclusion of the contract unless a different delivery period has been agreed.
If an order is delayed, customers may exercise their rights under applicable law, including requesting delivery within an additional appropriate period and, where legally permitted, terminating the contract.
For consumer deliveries, the risk of loss or damage generally passes to the customer when the customer or a designated third party other than the carrier takes physical possession of the goods, subject to applicable legal exceptions.
Culina Home remains responsible for its statutory obligations even when delivery is performed by an external supplier or carrier.
9. Order Cancellations
Customers may contact us at info.culinahome@gmail.com to request cancellation before an order has been dispatched.
Where an order can be cancelled before dispatch, we will arrange the applicable refund.
Once an order has been dispatched, operational cancellation may no longer be possible.
However, this does not affect any statutory right to withdraw from a distance contract, including the right to notify us of withdrawal before delivery where applicable.
Any refund following a valid cancellation or withdrawal will be processed in accordance with applicable law and our Return & Refund Policy.
10. Right of Withdrawal for Consumers
Consumers in the European Union and European Economic Area generally have the right to withdraw from an eligible distance purchase within 14 days without giving a reason. For purchases of goods, the withdrawal period generally begins on the day the consumer, or a third party designated by the consumer other than the carrier, receives the goods. Where goods from one order are delivered separately, the withdrawal period generally begins upon receipt of the last item. To exercise this right, customers must inform us of their decision to withdraw through an unequivocal statement, such as an email to: info.culinahome@gmail.com Customers may use the model withdrawal form provided at the end of these Terms, but its use is not mandatory. Sending a withdrawal notice before the applicable deadline is sufficient to meet the withdrawal deadline. Consumers must return the goods within 14 days after notifying us of withdrawal, unless we have agreed to collect the goods.
Return Shipping Costs: Culina Home will cover the reasonable direct shipping costs of returning products when a consumer exercises their statutory right of withdrawal within the applicable withdrawal period. Customers will not be required to pay standard return shipping costs.
Please contact us at info.culinahome@gmail.com for return instructions and to arrange prepaid return shipping or another suitable return method. This does not limit any statutory consumer rights.
11. Refunds Following Withdrawal
Where a consumer validly withdraws from an eligible purchase, we will reimburse the payments covered by that withdrawal, including the cost of standard outbound delivery where legally required.
We are not required to reimburse additional delivery costs resulting from a customer's express choice of a more expensive delivery method than the least expensive standard delivery offered.
Refunds will be made without undue delay and no later than 14 days after we are informed of the withdrawal, subject to the statutory right to withhold reimbursement until the goods are received back or the customer provides evidence of having returned them.
Unless otherwise agreed in accordance with applicable law, refunds will be issued using the original payment method without additional refund fees.
These provisions do not limit any more favorable mandatory rights available to consumers.
12. Defective, Damaged or Incorrect Products
Culina Home is responsible for products that do not conform to the purchase contract in accordance with applicable consumer protection law.
If a product is defective, damaged, incomplete, or different from what was ordered, please contact us at:
Include the order number, a description of the problem, and photographs where reasonably helpful.
Photographs are requested to help us investigate the issue but do not automatically constitute a mandatory condition for exercising statutory rights.
Under applicable Slovak consumer sales law, the seller is generally responsible for defects that become apparent within two years of delivery, subject to the relevant legal conditions and exceptions.
Customers may be entitled to repair or replacement, an appropriate price reduction, or termination of the contract and a refund where the applicable legal requirements are met.
Where Slovak law applies, a defect should generally be reported within two months of its discovery and within the applicable statutory liability period.
We will provide written confirmation of a reported defect and information about the applicable remedy and handling period as required by law.
Where a defect must be remedied, the announced period must comply with applicable law, including the relevant 30-day rule and its legally permitted exceptions.
Where we are legally responsible for a defect, the customer will not be required to bear costs that the seller must cover under applicable law, including necessary return or transport costs associated with the statutory remedy.
Nothing in these Terms excludes or reduces mandatory rights relating to defective or non-conforming goods.
13. Returns and Exchanges
Our Return & Refund Policy provides further practical information about returns, return instructions, cancellations, and refunds.
Return & Refund Policy:
For voluntary returns outside any statutory withdrawal or defect-related rights, additional conditions may apply if clearly communicated and lawfully agreed.
Exchanges are subject to product availability and any applicable statutory rights.
Please contact us before arranging an exchange so we can confirm the available options.
14. Product Safety
Customers must use products in accordance with the product instructions, warnings, and intended purposes.
Where required by applicable law, product listings or accompanying materials will provide relevant manufacturer, responsible economic operator, safety, and traceability information.
If you become aware of a potential product safety issue, please contact us immediately.
We will cooperate with applicable product safety requirements, including necessary corrective actions or recalls.
15. Privacy and Personal Information
We process personal information in accordance with our Privacy Policy and applicable data protection laws, including the GDPR where applicable.
Personal information may be shared with service providers where necessary for payment processing, order fulfillment, shipping, customer support, and other lawful purposes.
Our fulfillment partners may operate outside the European Economic Area, including in China. International personal data transfers are subject to applicable data protection requirements.
Privacy Policy: /policies/privacy-policy
16. Intellectual Property
The Culina Home website, its original content, branding, and other materials are protected by applicable intellectual property laws.
Ownership of third-party materials, trademarks, and other protected content remains with their respective rights holders.
Customers may use the website for lawful personal shopping purposes.
Unauthorized reproduction or commercial exploitation of protected website materials is prohibited, except where permitted by law or with the relevant rights holder's permission.
17. Third-Party Services and Links
Our website may include services, payment tools, or links provided by third parties.
These providers may operate under their own terms and privacy policies.
Culina Home is not responsible for unrelated third-party websites outside our control.
However, the use of Shopify, payment processors, suppliers, or delivery companies does not remove Culina Home's legal responsibilities toward customers under purchase contracts concluded with us.
18. Customer Reviews and Feedback
Customers may submit reviews, comments, or feedback through available website features.
Customers are responsible for ensuring that submitted content is lawful and does not infringe the rights of others.
By submitting content for publication, customers grant Culina Home a non-exclusive license to display and use that content for the purposes for which it was submitted, subject to applicable law.
We may remove unlawful or inappropriate content where permitted by law.
Where customer reviews are displayed, information about how reviews are collected and verified will be provided as required by applicable consumer protection law.
19. Website Availability and Acceptable Use
We aim to maintain a functional and secure online store but cannot guarantee uninterrupted website availability.
Customers must not use our website for fraudulent, unlawful, or malicious activities, including unauthorized access, distribution of malware, or interference with website security.
We may take proportionate measures to protect the website and its users, subject to applicable law.
Temporary website interruptions do not remove our obligations under purchase contracts already concluded.
20. Liability and Mandatory Consumer Rights
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
In particular, these Terms do not limit statutory consumer rights concerning delivery, product conformity, defects, withdrawal, refunds, or remedies for breach of contract.
Any limitations of liability apply only to the extent permitted by applicable law.
21. Alternative Dispute Resolution
We encourage customers to contact us first if they have a complaint or concern.
Customers may submit a request for remedy by emailing:
If a consumer believes that their rights have been violated and we reject their request for remedy or fail to respond within 30 days, the consumer may have the right to submit a proposal for alternative dispute resolution under Slovak Act No. 391/2015 Coll., subject to the applicable conditions.
A relevant alternative dispute resolution body for ordinary retail consumer disputes is the Slovak Trade Inspection:
Slovenská obchodná inšpekcia (SOI)
Website: https://www.soi.sk
Information about alternative dispute resolution bodies is also available from the Ministry of Economy of the Slovak Republic:
Alternative dispute resolution does not prevent consumers from exercising their right to bring a claim before a competent court.
22. Governing Law and Jurisdiction
These Terms and purchase contracts concluded through Culina Home are governed by the laws of the Slovak Republic, subject to applicable rules of private international law.
If a consumer habitually resides in another country, this choice of law does not deprive that consumer of mandatory protections applicable under relevant law.
Nothing in these Terms prevents consumers from bringing proceedings before courts that have jurisdiction under applicable consumer protection and private international law rules.
23. Language and Translations
These Terms are provided in English for international customers.
Where applicable law requires contractual information to be provided in Slovak or another language, we will comply with that requirement.
Translations may be made available for convenience.
No language provision in these Terms limits rights or protections granted by mandatory applicable law.
24. Changes to These Terms
We may update these Terms to reflect changes in our operations, services, or applicable law.
The date of the latest update will be displayed at the beginning of the document.
Changes will not retroactively alter the terms of an already concluded purchase contract without a lawful basis or the necessary agreement.
Where required by law, we will provide appropriate notice of material changes.
